These Terms of Service ("Terms") govern your use of Screencap, including the Mac app, the website at screencap.co, the in-browser recorder and the share pages (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Who we are
Screencap is operated by Dharma Loop LLC, a Wyoming limited liability company in the United States ("we", "us"). Screencap is an open-source fork of Cap (cap.so), released under the AGPL-3.0 licence. The source code is at github.com/ques123/screencap-web. These Terms cover our hosted Service; the open-source licence covers the code.
2. Eligibility
- You must be at least 13 years old, or older if your country sets a higher minimum age for using online services without a parent's consent (for example up to 16 in some EU countries). If you are under 18, or under that higher age, you need a parent or guardian's permission to use the Service, and they are responsible for your use of it.
- You must not be barred from using the Service under applicable law, and you must not have been removed from the Service before.
3. Accounts and sign-in
You sign in with a one-time code that we email to you. There are no passwords. You are responsible for keeping access to your email account secure and for everything that happens under your Screencap account. Give us accurate information, and tell us at [email protected] if you think someone else has accessed your account.
4. Your content and the licence you give us
Your recordings, screenshots, titles, transcripts and comments ("Your Content") belong to you. We do not claim ownership of them.
To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process (for example transcode video, make thumbnails and generate transcripts) and display Your Content to you and to the people you choose to share it with, including the public if you share a link without a password. This licence lasts for as long as Your Content is on the Service and ends shortly after you delete it, apart from backups, which roll off as described in our Privacy Policy.
You are responsible for Your Content. You promise that you have the right to record and share it. That includes getting consent from other people where the law requires it before you record their voice, image or private information, and having the rights to anything copyrighted that appears in a recording.
Anyone with a link to a recording that is not private or password-protected can view it and may be able to save it. Think before you share.
Encrypted recordings. If you turn on "End-to-end encrypt recordings" in the Mac app, those recordings are encrypted before upload and we cannot watch them (see our Privacy Policy). They have no transcripts, AI titles or summaries, no link preview images and no browser downloads. We cannot recover an encrypted recording if you lose both your Mac and the link, because we do not hold the key. You are responsible for who you share the link with, as anyone who has the full link can watch. We can still remove encrypted recordings and close accounts under the Acceptable Use Policy.
5. Acceptable use
You must follow our Acceptable Use Policy, which forms part of these Terms. In short: no illegal content, no abuse of other people, no malware or spam, and no using Screencap as a general file host.
6. Copyright and DMCA
We respect copyright. If you believe a recording on Screencap infringes your copyright, follow the steps on our Report abuse and copyright page. We remove infringing content when properly notified under the US Digital Millennium Copyright Act, and we close the accounts of repeat infringers.
7. Limits
Screencap is free to use. There is currently no limit on how long a recording can be or on how much video an account can store. The Pricing page always shows the limits that apply.
We may set or change limits, add paid plans or change how the Service works. If a change materially affects you, we will try to tell you in advance, for example by email or on the website. We will not charge you for anything without asking first.
8. Service changes and availability
We work to keep Screencap running but we do not promise it will be uninterrupted, secure or free of errors. We may add, change, suspend or end any feature, or the whole Service, at any time. Software has bugs, so keep your own copy of anything important.
9. Termination
You can stop using the Service at any time. You can delete recordings yourself, and you can ask us to delete your account by emailing [email protected] from the address on the account.
We may remove content, suspend or close your account, with or without notice, if you break these Terms or the Acceptable Use Policy, if your use creates risk or legal exposure for us or other people, or if we end the Service. If we close your account for breaking the rules, you may not create another one. Sections that by their nature should continue after termination (including ownership, disclaimers, limitation of liability, indemnity and governing law) will continue.
10. Third-party services
We rely on other companies to run Screencap, including Cloudflare and Hetzner, described in our Privacy Policy. The Service may also link to other websites. We do not control third-party services or sites and are not responsible for them. Your use of them may be subject to their own terms.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT YOUR CONTENT WILL NOT BE LOST OR CORRUPTED. WE ARE NOT RESPONSIBLE FOR CONTENT UPLOADED BY USERS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO USD 50. Some places do not allow certain limits, so parts of this section may not apply to you.
13. Indemnity
You agree to defend, indemnify and hold us harmless from claims, damages, losses and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
14. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to the exclusive jurisdiction and venue of those courts, except where applicable law gives you a non-waivable right to bring proceedings in your country of residence. If you use Screencap as a consumer, you also keep any mandatory consumer-protection rights of your country of residence that the law says cannot be waived.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will change the "Last updated" date above and, where appropriate, tell you by email or on the website. If you keep using the Service after changes take effect, you accept the updated Terms.
